Porn providers need to accept defeat in court
First, two of the three platforms complained against the decision of the KM — but even before the Administrative Court in Düsseldorf, the youth guards have now sailed. Among other things, the providers have relative to the country of origin principle of the EU, according to which only the law of the country is used, where the seat of the respective company is located.
European Court of Justice allows exceptions to the country of origin principle
However, as an EU Member State — in this case Germany — wants to ensure the protection of its population, appropriate exceptions to the country of origin are allowed. Now the youth media protection right is used.
Porn providers need to deny minors the access
A simple youth protection label when calling the website, the KM is not sufficient. The platforms must now introduce new systems with which the age of the Internet user can be verified. But the providers can still appeal against the verdict.
Decision has no impact
However, there were no changes in the porn providers. Already last year, KM Chairman Marc Neumann threatened with further appeals, the platforms should not respond to the decisions. Among other things, you wanted to force a grid lock here. But the providers of portals have rejected that.
